OK, sure! That's a perfect example of discriminatory treatment (the cap counts against your services, but not mine). So it's that discrimination, not the cap per se, that constitutes a NN problem.

Unless the provider's own services do not count against the cap and competitors do -- noting that it's a complicated and thorny issue.  But I wouldn't say "quintessentially".
